Wills and Trusts
Ensuring your family and loved ones are taken care of is a common reason why many people choose to establish a trust or a will. At Surani Associates, we can assist you in planning for the future and creating a will or trust for you and your family.
Wills
A will is a legal document that states what will happen to your property when you die and how you want your dependents (spouse/partner, children, pets, etc.) to be looked after.
Eligibility: Anyone who is of sound mind and 18+ years old can make a will. Under 18s can also make a will in certain circumstances.
Flexibility: You can make a will at any time, and you do not need to have a lot of valuable assets. You can cancel or change your will at any time and should revise it approximately every five years or whenever your circumstances change (e.g., ending a relationship).
Intestate: If you die without a will (referred to as ‘dying intestate’), the law will decide how your property is distributed, usually to your surviving spouse and immediate family. If you have no family, the property goes to the State.
Our team at Surani Associates can assist with drafting a will, distributing assets, asset planning, and estate administration.
Trusts
Trusts are another way of handling your property, either to protect your assets, support your family and loved ones, or both. Trusts are created by a document known as the ‘trust deed’ and can be created by wills as well.
Creation: A trust is created when a person (the ‘settlor’) transfers their property to others (the ‘trustees’). Trustees are obligated by law to use the transferred property for the specified purpose, benefiting the ‘beneficiary’. For example, if the trustees rent the property, the beneficiary must receive some of the rent payments.
Complexity: Trusts can be complicated, so legal help is advisable for understanding, creating, managing, and closing trusts. This includes advice on trustee obligations, gifting, trust administration, retiring or appointing new trustees, and resettlement.
Our team provides comprehensive legal support for all aspects of trusts.
