Separation does not always lead to divorce, but it does dramatically change your circumstances. There is no formal document required to confirm that you have separated. “Separation” occurs when one person communicates to the other that the relationship has ended and that both parties will no longer live together as husband and wife or as de facto spouses. Separation can happen by one person moving out, or both parties can be “separated” while living under the same roof, as long as they lead separate lives.

Those wishing to remarry must divorce their ex-partner first. Once granted, a divorce becomes final or “absolute” one month after the court order, unless special circumstances apply.
