Permanent resident not living in New Zealand – Not eligible.; Citizen not living in NZ – Eligible. Permanent resident lived 8 months preceding the S & P date – You will require a consent from OIO (Overseas Investment Office); Permanent resident living in NZ for more than 12 months, wife on work visa living in NZ for more than 12 months – both eligible provided the property remains relationship property.

What kind of conditions do I need to put in the agreement?

Depends on the situation and the kind o property they are buying. If it is an existing property – Finance, LIM, Building Report, and Title are the standard terms. If under constructions – where the Title is yet to be issued – if the property is not subdivided yet – then we make sure the price adjustment clause is inserted, sunset clause etc.

For example, if you have a freehold title then you have absolute right over the property and you are at liberty to do anything (legal) with your property, however, if you have a leasehold title then you may be restricted in what you can do. Your title will also have information about whether the property has a mortgage on it or not. Information about your land title is held by Land Information New Zealand (LINZ).
