Relationship Property / Contracting-Out Agreements

Separation
Separation can change your circumstances dramatically. There is no formal document required to confirm separation; it happens when one party communicates that the relationship has ended. It's important to obtain legal advice to understand your rights, responsibilities, and entitlements.
Divorce / Dissolution
Parties must be separated for more than 2 years before applying for a dissolution of marriage. Divorce becomes final one month after the court order unless special circumstances apply. Our team prepares all necessary paperwork and files your application in the Family Court.
Child Support
Child Support is financial support for children whose parents do not live together. Payments are calculated based on the adjusted taxable income of both parents. Parents can resolve and agree on Child Support matters themselves through a voluntary agreement, which must be accepted by the IRD.
Care of Children
Post-separation or divorce, it's important to have arrangements for children in place. The court encourages parents to reach agreements on parenting arrangements. Our family lawyers assist in negotiations and can draft consent orders to formalise agreements.
Spousal Maintenance
After a relationship ends, you may be entitled to receive maintenance from the other party for your reasonable needs if you cannot meet them practicably. Maintenance is based on several factors, including the ability to become self-supporting, responsibilities for minor children, and standard of living during the relationship.
Domestic Violence
Domestic violence includes physical, sexual, psychological, or emotional abuse. Victims can apply for a protection order under the Domestic Violence Act 1995. It's possible to obtain a protection order without forewarning the abuser.
