Important Updates: AEWV Changes for Business Sales and Mergers
Learn about new changes to accreditation rules affecting AEWV holders during business sales or restructures, effective from 6 November 2024. Understand what these changes mean for employers and employees.
Kia ora everyone,
Immigration New Zealand has announced significant changes to accreditation and Job Check processes, specifically targeting situations involving business sales or restructures. At Surani Associates, we want to ensure you understand these important updates and their implications.
Key Changes (Effective 6 November 2024):
Job Changes During Business Transitions
AEWV holders must apply for a Job Change even if staying in the same role and location
New employer must hold or have applied for accreditation
Job Changes can be approved before the new employer's accreditation is finalized
Job Check Requirements
No new Job Check needed if the role and location remain unchanged
Job Checks required only for changes in role or work location
Employee Quota Considerations
AEWV holders transferring to new employers count towards the 5-employee quota under standard accreditation
Employers exceeding this limit should apply for high-volume accreditation before Job Change applications
Impact on Employers:
Standard Accreditation Holders:
Monitor AEWV employee numbers during transitions
Plan ahead for potential high-volume accreditation needs
Acquiring Businesses:
Apply for accreditation early in the acquisition process
Consider existing AEWV holders in workforce planning
Impact on AEWV Holders:
Same Role, New Owner:
Must apply for Job Change
Can continue working while Job Change processes
No new Job Check required if role unchanged
Role or Location Changes:
Additional requirements may apply
New Job Check needed
