Important Changes to the Migrant Exploitation Protection Work Visa (MEPV)

Key updates to MEPV regulations effective 31 October 2024, including changes to second MEPV applications and revised definitions of migrant exploitation. Learn what these changes mean for you.

Immigration New Zealand has announced significant changes to the Migrant Exploitation Protection Work Visa (MEPV). At Surani Associates, we want to ensure you understand these important updates and their implications.

Key Changes Effective 31 October 2024:

  1. Second MEPV Applications:

  • The ability to receive a second MEPV will be removed

  • Applications for second MEPVs will be assessed if received by 30 October 2024

  • Those with initial MEPVs expiring on or before 30 November 2024 can apply for a second MEPV before 30 October

  1. Revised Definition of Migrant Exploitation: Employment New Zealand will no longer consider the following as exploitation:

  • Lawful employment terminations and redundancies

  • Non-payment of final wages due to liquidation

  • Situations without genuine employment relationships

  1. Current MEPV Provisions Remaining:

  • Migrants with credible exploitation reports can still apply for up to six-month MEPVs

  • This allows them to leave exploitative situations legally

  • Provides time to find new employment in New Zealand

For Current MEPV Holders:

  • Review your visa expiry date

  • Consider your options before 30 October if eligible for a second MEPV

  • Plan your next steps accordingly
